It is the policy of Sappi North America (“SNA”) to expeditiously respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (“DMCA”).

It is expected that all users of any part of SNA’s website (“Site”) will comply with applicable copyright laws. However, if SNA receives proper notification of claimed copyright infringement, our response to these notices will include removing or disabling access to material claimed to be the subject of infringing activity and/or terminating users.

If we remove or disable access in response to such a notice, we will make a good-faith attempt to contact the provider of the content so that they may make a counter notification pursuant to Sections 512(g)(2) and (3) of the DMCA.

Upon receipt of proper notification of claimed infringement, SNA will follow the procedures outlined herein and in the DMCA.

Infringement Notification

If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide SNA's Designated Agent (listed above) the following information in a written communication (preferably via email):

1. A physical or electronic signature of the owner of the copyright or a person authorized to act on behalf of the owner;

2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;

3. Identification of the URL or other specific location on our Website where the material that you claim is infringing your copyright interest is located;

4. Your name, mailing address, telephone number and email address;

5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Please note that you may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that material is infringing your copyrights. Accordingly, if you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney.

Counter Notification

If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, you may send us a counter-notice in accordance with Sections 512(g)(2) and (3) of the DMCA.

Repeat Infringers

In accordance with Section 512(i)(1)(a) of the DMCA, SNA will, in appropriate circumstances, disable and/or terminate the accounts of users who are repeat infringers.

Accommodation of Standard Technical Measures

It is SNA's policy to accommodate and not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works that SNA determines are reasonable under the circumstances.
